VIDEO: A Look at President Trump’s New Anti-LGBTQ Federal Judgeship Nominee Kyle Duncan

By Shane Stahl • February 6, 2018 • 11:23 am

Last November, President Donald Trump nominated a notoriously anti-LGBTQ attorney, Kyle Duncan, for a lifetime appoint to the U.S. Court of Appeals for the Fifth Circuit. Currently, his nomination is being considered before the Senate Judiciary Committee, with opening statements delivered on November 29, 2017.

This week, our partners at Lambda Legal have put together a comprehensive video that shows Mr. Duncan’s history of discriminatory and hurtful opinions on issues from marriage for same-sex couples to transgender children. Watch the video:

Duncan fought vigorously against the freedom to marry before the landmark Obergefell decision in 2015. Mr. Duncan organized an amicus brief of 15 states that he filed with the Supreme Court in opposition to marriage equality. In response to the Supreme Court decision in Obergefell, Mr. Duncan questioned the legitimacy of the Supreme Court in his personal statements.

More recently Duncan has focused on the transgender community, specifically transgender youth. He defended North Carolina in its decision to pass HB2, one of the most anti-LGBTQ pieces of legislation ever passed in a state legislature, banning transgender people from using the restroom that corresponds to their gender identity. In addition, he served as lead counsel for the school district seeking to ban transgender student Gavin Grimm from using the boys’ bathroom and advocated that parents should discourage so-called ‘transgender persistence.’

We are grateful to Lambda Legal for providing this informational video, highlighting the reasons that Kyle Duncan should not receive a lifetime federal judgeship. To contact your Senator and demand they work to prevent the appointment, click here.
