The School of the Ozarks enlisted Alliance Defending Freedom to file suit in April of 2021 claiming that a federal Housing and Urban Development memorandum issued in response to Bostock and President Biden’s Executive Order that set forth HUD’s policy to interpret the Fair Housing Act to protect transgender individuals violated its rights of religious freedom, free speech, freedom of association, and free assembly rights and violated the Administrative Procedure Act.

A federal district court in Missouri denied a preliminary injunction and dismissed the challenge. The school appealed and argument of the appeal will be held in November of 2021.
