LGBTQ Non-Discrimination in Delaware:

Since 2009, LGBTQ non-discrimination in Delaware has protected people from discrimination in housing, employment and public accommodations on the basis of sexual orientation. In 2013, that law was expanded to include gender identity and expression.

The Path to LGBTQ Non-Discrimination in Delaware:

  • December 9, 1990: The University of Delaware enacts a policy prohibiting discrimination and harassment against people based on their sexual orientation, one of the first instances of LGBTQ-inclusive non-discrimination in the state. 
  • March 2001: Delaware lawmakers in the House pass HB 99, which prohibits discrimination based on sexual orientation in housing, employment, and public accommodations. The bill is stonewalled by opposing lawmakers the next year. Previously, similar legislation had been introduced but voted down, and over the next several years legislation prohibiting anti-LGB discrimination advances through several committees and chambers but does not successfully pass through the legislature.
  • February 10, 2009: The City of Newark updates its non-discrimination personnel policy to include gender identity and expression; sexual orientation discrimination had been prohibited since 2004.
  • June 2009: After 11 years of attempting to pass legislation prohibiting discrimination based on sexual orientation, Delaware lawmakers at last pass affirming legislation (SB 121) by a wide margin.
  • August 11, 2009: Governor Jack Markell issues an executive order prohibiting discrimination against LGBTQ employees of state executive branch departments and agencies. 
  • July 19, 2013: Having passed the legislature, Governor Markell signs The Gender Identity Nondiscrimination Act of 2013, which prohibits discrimination against transgender people. The governor’s signature makes Delaware’s LGBTQ non-discrimination protections fully comprehensive.
  • March 23, 2016: The Delaware State Insurance Commissioner issues a bulletin, citing the 2013 non-discrimination act, prohibiting insurance companies from limiting or excluding healthcare for transgender people.
